Privacy and Communications Policy

This Privacy Policy is issued by Oaktree Health and Wellness, LLC, doing business as Everest Diabetes & Endocrinology, Everest Diabetes & Weight Loss, and Everest Eclinic (collectively, “Everest,” “we,” “us,” or “our”).
It explains how Everest collects, uses, discloses, and protects personal information when you use our websites, submit an online form, schedule care, communicate with us, or otherwise interact with
Everest. This policy supplements, but does not replace, our HIPAA Notice of Privacy Practices when protected health information is involved.


1. Information We Collect

Information you provide directly

  • Contact information, such as your name, telephone number, email address, and mailing address.
  • Appointment and inquiry information, including requested services, preferred dates or times, and questions you choose to submit.
  • Health-related information you voluntarily provide through intake forms, secure portals, telehealth systems, or communications with Everest
  • Billing, insurance, pharmacy, laboratory, and transaction information needed to coordinate care or process services. Payment-card information may be processed directly by our payment providers.
  • Communication preferences and records of your consent, opt-outs, and interactions with text messages or emails
  • Information submitted through social-media or advertising lead forms, reviews, surveys, testimonials, or patient-story permissions.

Information collected automatically

  • Internet Protocol address, browser type, device type, operating system, and approximate location derived from your network connection.
  • Pages viewed, links clicked, referring pages, dates and times of visits, and other website-use information.
  • Cookie, analytics, and similar technology data used to operate, secure, measure, and improve our website and advertising.

Information received from others

Where permitted and appropriate, we may receive information from scheduling, telehealth, patientportal, electronic health-record, laboratory, pharmacy, payment, insurance, communication, analytics, and advertising providers, as well as from people you authorize to communicate with us.

2. How We Use Information

  • Schedule, confirm, reschedule, and administer appointments.
  • Provide, coordinate, document, and improve health care and related services.
  • Verify identity, maintain patient records, and operate secure patient systems.
  • Coordinate with laboratories, pharmacies, health plans, payment providers, and other parties involved in requested services.
  • Send appointment, administrative, and care-related communications when permitted.
  • Send educational or promotional communications only as permitted by law and consistent with your choices.
  • Operate, secure, troubleshoot, analyze, and improve our websites, forms, services, and patient experience.
  • Prevent fraud, protect rights and safety, comply with legal obligations, and enforce our policies.

 
3. How We Disclose Information

We may disclose information only as appropriate for the following purposes:

  • Service providers and business associates. Vendors may process information to support website hosting, scheduling, telehealth, patient records, secure messaging, communications, payments, analytics, information security, and other operations. They may use the information only to provide contracted services and are subject to applicable confidentiality and data-protection obligations.
  • Care coordination and payment. Information may be disclosed to health care providers, pharmacies, laboratories, health plans, and other parties involved in treatment, payment, or health care operations, as permitted by law
  • Legal and safety purposes. Information may be disclosed when required by law, legal process, licensing requirements, regulatory requests, or when reasonably necessary to protect patients, Everest, or others.
  • With your direction or authorization. We may disclose information when you ask us to or give permission.

Everest never sells personal information.

Mobile information and text-message opt-in data and consent will not be shared with third parties or affiliates for their own marketing or promotional purposes. This restriction does not prevent providers that operate Everest’s messaging systems from processing information solely as needed to deliver and support the messages you requested.

 
4. Text Messaging and Email Communications

When you provide contact information and choose to receive communications, Everest may send appointment confirmations, reminders, scheduling updates, administrative care messages, educational information, or other communications related to your interaction with Everest.


Promotional text messages are sent only when you separately choose to receive them. Marketing consent is not required to book an appointment or receive services. You may withdraw consent at any time by replying STOP to a text message or by using the unsubscribe option in an email.


Message frequency varies. Message and data rates may apply. Reply HELP to a text message for assistance, STOP to opt out, or START to resume messages after opting out.


Text messaging and ordinary email are not fully secure. Do not use them for emergencies, complete medical records, or sensitive medical questions unless Everest specifically directs you to do so. Call 911 for a medical emergency and use the secure patient portal for detailed clinical communications. Additional SMS program rules are available in our Text Messaging Terms & Conditions


5. Cookies, Analytics, and Advertising

Everest and its website providers may use cookies, pixels, analytics, and similar technologies to keep the website functioning, remember preferences, understand site use, detect security issues, and measure advertising performance. These technologies may collect device, browser, network, and website-interaction information.
You can manage cookies through your browser settings. Disabling cookies may affect some website functions. Everest does not authorize analytics or advertising providers to use clinical information or text-message opt-in data for their own marketing.

 
6. Protected Health Information and HIPAA

Information created or received as part of your health care may be protected health information governed by the Health Insurance Portability and Accountability Act (HIPAA) and other health-privacy laws. No website, transmission method, or storage system can be guaranteed to be completely secure. You are responsible for protecting access to your devices, email, text messages, passwords, and patientportal account.


8.Data Retention

We retain personal information for as long as reasonably necessary to provide services, maintain medical and business records, comply with legal and professional obligations, resolve disputes, enforce agreements, and protect our operations. Retention periods vary according to the type of
information and applicable requirements.


9. Your Choices and Rights

  • Communication choices. You may opt out of promotional emails through the unsubscribe link and opt out of text messages by replying STOP. Opting out of marketing does not affect services you request.
  • Cookies. You may adjust browser settings to reject or delete cookies, subject to possible loss of website functionality.
  • Personal-information requests. Depending on applicable law, you may have rights to request access, correction, deletion, or information about certain uses of personal information. Some information may be exempt, including information governed by HIPAA or required for medical, legal, security, or recordkeeping purposes.
  • Protected health information. Rights concerning medical records and other protected health information are described in our HIPAA Notice of Privacy Practices.

Our general website is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through the website without appropriate authorization.
